Listed below is a 12 month timeline of documents and events that happen during the probate estate process. Please note that the length of time needed to complete the probate estate process depends on the complexity and size of the estate. The timeline below is just to give you a general idea of the probate process.
Month 1- File Petition to open probate, court case number is assigned
Month 2- Notice is given to the heirs and family members that the probate is being opened
Month 3- Petition to appoint Executor/Administrator (Exec/Admin) submitted to court
Month 4- Court appoints Exec/Admin, probate is now formally open
Month 5- Exec/Admin creates inventory and establishes value of assets; Publish notice to creditors
Month 6- Receive Claims from creditors; Accepts or reject claim
Month 7- Assets, including real estate, are sold (large estates may take a long time)
Month 8- Decadents' debts are paid, Tax returns are filed (In large estates, approval of tax returns can cause long delays)
Month 9- Once assets are sold and taxes approved, Exec/Admin files Petition to Distribute Assets
Month 10- Notice of final hearing is sent out to heirs and family members
Month 11- Final court hearing; Judge reviews estate and approves distribution
Month 12- Exec/Admin sends out checks to heirs
